Recovery of legal fees after case dismissed

Local school district sued for unfair election statutes by private parties. Case moved to and eventually dismissed by Illinois Central District Court. Atty for school dist advised defendents it would probably cost as much to recoup legal fees as the amount being recovered ($12,000.) so it would not be ''cost prudent'' to attempt recovery. What do you think?
