Legal Question in Civil Litigation in Illinois

Can small claims court be avoided if a lawyer sends a letter in the mail notifying a potential defending party that she owes money, and if not, she will be taken to court? Does this final notice scare most offenders?

Some, certainly not all. I would say it is effective for the majority of individuals who are able to pay, but of course, some are simply unable to pay, so no amount of coercion is effective.
