It depends on what the nature of your complaint is. For instance is it based on a written contract? If so then its 10 years. You can find the statute of limitation by checking the Illinois statutes or doing an internet search for "illinois statute limitation"

In Illinois it makes no difference between statute of limitation on a case in small claims court or on a similar case in the municipal or the law division. Statute of limitations vary and are based on the type of case you may have.
