Legal Question in Immigration Law in Illinois

from B2 to F1

I currently have H2B visa till april 15 2006 and vork in MN state. My plans are to study in USA. But I'm affraid, that I won't find a college or university till my visa expires. So I'm planning to get B2 visa.

1 Q: What are the possibilities to get F1 visa having B2. I read, that is more complicated, than transfering to F1 visa from H2B.

2.Q: If I will apply for F1 visa untill april 15, will I be legal after april 15 while my F1 visa process vill be pending?

The Immigration Service will highly scrutinize any application for a change of status to F-1. Once your application is filed, you are typically allowed to remain in the U.S. until a decision is rendered, assuming that you were "in status" at the time of filing.

Note: As one who is currently in H-2B status, due to the H-2B cap, you would be a highly sought after employee by H-2B employers.
