No, you can't. Unless you have a valid long-term non-immigrant visa (e.g. work visa, etc). You have to wait for your priority number to become current in India (currently, it takes 9 years).

If youd like to schedule a telephone or email legal consultation, need legal advice or help, please let me know and Id be glad to help you. I am an immigration attorney and offer confidential consultations and legal help in matters of the U.S.A. federal immigration law to clients from all 50 States and internationally. Please email your inquiries at Attorney @law-visa-usa.com and Ill send you a Questionnaire. Office Telephone line is 1-402-210-2040 (please EMAIL first to schedule a consultation appointment with an attorney).

Hi,

You cannot legally remain in the U.S. without a visa category which allows for intention to immigrate to the U.S. (such as H1B or L1 employment-based visa categories which require a suitable job offer and appropriate qualifications).

You can call our law firm at 212-268-3580 during business hours if you have a job offer and would like to discuss further.
