Legal Question in Intellectual Property in Illinois

My girlfriend recently had a stroke and was under 24/7 watch. But one night (12 midnight) she put her clothes on walk right past the nursing station got on the elevator and walked all the way home. The hospital didn't notice her missing for almost an hour. Can I sue the hospital over this? Thanks

Im sorry to hear about your girlfriend's problem. This question does not relate to intellectual property, so you should resubmit the question. As an IP attorney I can tell you this, it is very unlikely you would be able to win a lawsuit against the hospital because you most likely do not have "standing". "Standing" is a legal term by which you must actually be injured to bring an action. If this was your wife, parent, child or other close relative then you might have standing, but almost certainly not for a girlfriend. If your girlfriend was actually injured due to the hospital's negligence then your girlfriend's family should consult an attorney.
