Legal Question in Landlord & Tenant Law in Illinois

My brother has lived with my grandmother in the same apartment for the past 21 years. Rent has always been paid on time and in all those years as family is family, my brother was never technically added to the lease; the management company knows he is also a tenant. My grandmother unfortunately passed away and now my brother is wondering what his legal rights are regarding his ability to remain a tenant given that he is not on the lease but has been an occupant all this time. His continuing to pay rent isn�t a problem and would remain the same.

He may have no rights other than as a month-to-month tenant but if your grandmother had a lease he MAY be able to persuade the management company to let him take it over.
