Legal Question in Landlord & Tenant Law in Illinois

evicting a spouce

My husband has left our apartment and moved elsewhere. He has not reponded to several attempts to remove the rest of his belongings. What can I do legally to get his belongings out of my home.

Re: evicting a spouce

Assuming you know where he is, I'd just cover yourself and send him a letter to the effect of it's my understanding you've left our apartment and are residing elsewhere, please remove your belongings within 7-10 days or I'm putting them in the garage or disposing of them. I wouldn't rush it and I'd suggest you be patient.

How I could potentially see you getting hurt would be if either of you would pursue a divorce case. Then all this property is what's known as "marital property" and I could see a court requiring you to reimburse him for disposing of this, particularly if there are items of value.

Please email or call if I can be of any further assistance.
