Legal Question in Landlord & Tenant Law in Illinois

Relocation fee

Currently myself and fiance and 2 children are renting a house in Lombard,IL. I was told last week that we had 3 months to find another place to live because the place that owns and manages the house we are in decided to demolish the house we are in and 2 others on the same side of the street. I was wondering if they are required to give us a relocation fee.

Re: Relocation fee

Hello. Several years ago I represented a family

who had to move because White Sox Park (now

Cellular Field), was building the present ball park. The Illinois Sports Authority paid for my client's move and new residence. That was a condemnation proceeding where the state or city has to reimburse residents who are displaced by public building projects. My question to you is "do you have a lease, or are you a month to month tenant? If you have a lease and there is no mention in the lease of what will happen, if the landlord decides to demolish the property; in my opinion, you are entitled to compensation and damages from your landlord, because the landlord is "breaking" the lease when

you have to leave before the term of the lease

is over, because the landlord is going to demolish the building. If you are a month to month tenant, the landlord only has to give you a

30 day notice (notice of termination of tenancy)

and you will be required to move within 30 days.

If you do not move, the landlord can take you

to court, however the landlord cannot come into

your apartment and move you out. That is breaking and entering; a felony. Only the Sheriff of the County in which you live can

move you out, after a court has awarded the

landlord a judgment for possession of the

rented space. Please feel free to ask any

additional questions that you might have!
