Slum Landlord

I just found out my former landlord in Decatur Il filed a lawsuit and was awarded the lawsuit due to me not showing up in court. The summons was given to a former roomate and I was not notified since I moved home after graduating from college. Now the lawsuit is on my credit file and the lawyers said since I did not change my address that I was legally obligated to pay the fines. The landlord signed a contact before moving in stating all the problems with the house would be fixed prior to us moving in (mold, leaky roof, exposed wires in the basement) or we would not pay rent until all the problems were fixed. The landlord had 3 months before we moved in and still the house did not have all the repairs made. Since I was going back to school I did not have time to find another place to live so I stayed at the house and called the landlord numerous times regarding the repairs and did not get a call back. I started to feel guilty so I paid all but 2 months of the 9 months rent. Now the landlord filed the suit knowing I was moving home and I would not get the summons. Do I have any rights in this case. I was also in the hospital due to the mold spores in the home and incurred $5000.00 in medical bills.

You need to get an attorney to help you with vacating the default and quashing service, then proceeding to assert your defenses. Or, you can just pay the judgment and be done with it.
