Legal Question in Landlord & Tenant Law in Illinois

I am a tenant in Illinois facing eviction. However, my landlord did not file the case. The maintenance man is the one who filed. My lanlord's name does not even appear on the court summons or five day notice. Can I use this as a defense when I appear in court?

Possibly. Since the mainenance man is not the owner, he has no right of possession. He may also have a problem since it sounds like he is engaging in the unauthorized practice of law--in other words, he is essentially representing someone else in court. Not a good thing to do in front of a judge.
