tenants in the basement?

my father ownes a house.he had a friend at work that needed a place to stay.so my father let him stay in tha basement. he moved his whole family in with out asking, he smokes and my kids are getting ear infection allthe time do to the smoking. theres fighting ever night. my father asked him to move but he said no.I think my father is scared of this man because he is very violant. iIdont know what to do?i cant move out i pay the morgage. wht can i do if the basement is not even an apartment . its a family home. and there not family!!!!!

The first step I'd take would be to just change the locks and essentially lock them out. If there's not a written lease it's not like they could call the cops and say they have a right to possession of that unit.

If your father isn't comfortable with that method, then really the only other option would be akin to evicting a tenant...filing a lawsuit and getting an Order of Possession from a judge and eventually the Sheriff would remove them.
