Legal Question in Medical Malpractice in Illinois

Mental illness and statute of limitations

Eight years ago I suffered a mental illness following surgery. The hospital knew this and the mental health professionals I saw knew this, yet I was continually misdiagnosed to keep the problem hidden. I have lost everything and am currently disabled. Since I was mentally ill and incapable of serving my self interest and the Doctors would not help, can I get around the statute of limitations and if not can I sue the hospital for discrimination.

Re: Mental illness and statute of limitations

If you were incompetent, it may be possible to file a malpractice suit if your return to competence was less than two years ago. You have provided no facts indicating that there was discrimination.
