Nursing home fall end in death

My husband was in a VA nursing home. He was given medications that the doctor knew could cause him to fall. I was his power of attorney and did not agree to this medication. I was told if I didn't agree he would have to find other residence. Well, after a short time, he fell, broke his hip, and had hip surgury. Because of his mental and physical condition, he was sedated and kept in restraints for 5 weeks and then died from asperation pnmonia. Do you think I have a case?

It is hard to assess whether you have or do not have a cause of action against the nursing home. We must take a look at the medical records and have an expert opine as to whether or not whatever medication he was given was necessary etc...

I suggest you request the entire medical records and have a person look at it to make a determination as to whether the nursing home doctor failed to follow the standard of care.
