Legal Question in Medical Malpractice in Illinois

Did not sign consent

When my son was born,he was given a shot in the hospital that i did not agree to,in fact i specifically declined it on the consent form.Is there anything i can do? The hospital had an ''oh well'' attitude which is what made me angry. They tried to say he was not given the the shot until i told them it was on my bill. How can they get away with that?

Re: Did not sign consent

They can get away with it because it would be too costly to fight this issue in Court. You can file a battery charge against the Hospital. Beware, they may decide it is worth the fight in which case you may need the help of an attorney and may have to pay a retainer.

Meanwhile, I would suggest you not pay for the procedure you have been billed and have specifically declined.

I hope this helps!
