Auto accident

my nephew was involved in an auto accident when he was 10 years old, his grandmother was killed and he was hospitalized for several months. Upon his 18th birthday last month he was sent $12,000! I thought the interest on his settlement would be that amount. Can he sue now that he is an adult?

It sounds like his claim was already settled if he received a payment. If that is the case, he can not file unless his settlement was not approved by the court. You should take the paperwork to an attorney to review.

If he received $12k on his 18th birthday, in all likelihood the money was the money resulting from a settlement placed into a bank account for safe keeping until his 18th birthday.

If there was a settlement, and it was approved by the Probate Court, the settlement has been reached and there is nothing that can be done now.

Your best option is to take all the paperwork and have it reviewed by an attorney to make sure.
