Auto accident

I was in an auto accident last year, I was hit by a truck

now the insurance company for the trucking company has refused to pay my claim, I now have a attorney, and we are

suiting the insurance company. Do these cases normally goto

trial?

If they have decided that they do not want to settle the case with you and a suit had to be filed, chances are that the case will have to be taken all the way to trial. You may be pleasantly surprised on the day of trial but don't count on it. According to my experience, about 11 to 12% of my cases actually end up being tried... I don't know what that tells about your suit !

No. Often, they are settled on the morning of trial. But they often go to arbitration first.

Most injury cases do not go to trial, however, much depends on your attorney. If you have an experienced trial attorney, the insurance company is less likely to force a trial, and more likely to settle out of court. However, even the best of cases and attorneys sometimes result in trials. But rarely.
