There are no formulas and there are no correct/incorrect amounts. The settlement amount is a function of the following:

1. The facts of the case: how the injury occured;

2. contributory negligence, if any;

3. nature and extent of the injury;

4. type of the doctor(s) seen;

4a: type medical treatment received;

5. time span for the medical treatment;

6. the amount of the medical bills;

7. pre-existing conditions, if any;

8. prognosis;

9. defendant: how good/bad witness he or she may make in front of a jury;

10. plaintiff: how good/bad witness he or she may make in front of a jury;

11. many other factors.

I hope this helps-

The attorney above is correct.

There are many factors in determining a personal injury settlement.

If you do not have an attorney, I suggest you retaqin one. Studies have shown that parties represented by attorney regularly recieve double the settlement amounts of unrepresented claimants.

Hi. I am an Illinois and Missouri injury attorney that handles claims in central and southern Illinois and most parts of Missouri as well.

Additional details would be needed in order to present an approximation of the settlement range, as well as the amount you should ask for from the insurance company. What type of injury did you incur? (the type of injury is critical in determining settlement value). Will there be medical treatment necessary in the future? (including physical therapy). Did you miss any time from work due to treatment for your injuries? Do you have any on-going or permanent conditions, pain, loss of range of motion, weakness, etc?

These are the type of details that are relevant in making an approximation of the settlement range you could be looking at. In fact, even the insurance company that you are dealing with is relevant. There are many ways to increase the value of your settlement as well. And yes, the issue of whether you were partially negligent will affect the settlement also.

I can be reached, for your convenience, by e-mail at [email protected]. Thank you.
