Legal Question in Personal Injury in Illinois

Dismissing an attorney

I was in an auto accident that was not my fault. I had to retain an atorney to get papers for short term disability I was out of work for 3 weeks the papers were never sent. I just finished 4 months of therepy. My insurance company just informed me the other driver did not have insurance. They will pay my medical and lost wages. I do not want to sue my own insurance company all I want is medical bills paid and lost wages with they will pay me. How do I dismiss my attorney.

Re: Dismissing an attorney

You can dismiss your attorney by telling him that he is dismissed. Preferably, you should do so in writing.

Now, talking about reality:

If the other driver did not have insurance, your ONLY viable chance of getting any money is to file a claim with your own insurance for Uninsured Motorist coverage. You do not have to do this--and in all likelihood you will NEVER get paid for anything including your medical bills. You can go ahead an sue the other driver, and perhaps even get a judgment against him... but good luck collecting!!! Perhaps, after 3 to 4 years you will get a dollar or two to perhaps break even in the cost of litigation.

You have 2 choices:

1- Make a claim for uninsured motorist and get your medical bills paid; or

2- close the case and go on about your business.

I hope this helps,
