Legal Question in Personal Injury in Illinois

Fell down stairs while dog sitting

I fell down the stairs (which are very steep and narrow) at my parents home, they were home and preparing that morning to leave ( I was there to dog sit for them) for MO (a funeral) They took me to the hospital where I had xrays & the hospital referred me to a surgeon who said the injury required surgery I was scheduled for surgery (had surgery where they put a rod and 8 screws near my ankle) two bones were broke and the ligament tore from my ankle We submitted an accident report to the insurance company and today I recieved a letter stating (The insurance company has met its obligation on your account. The balance due is now your responsibilty) This is only the hospital, I will still have the doctor, therapy, & lost wages at work, etc.... What do you suggest we do?

There are two kinds of insurance coverages involved here. The first is medical payments, which applies to any medical care required as result of an injuty on your parent's premises, regardless of fault. Coverage limits are usually $1000, $5000 or $10,000. There is also liability coverage. That coverage requires establishing fault on the part of your parents. You need to contact an attorney. It will be necessary for a visit to your parents' home.

Your injuries are very serious! Feel free to contact me so that we can discuss your case in more detail.

Respectfully,

This is an absolute nonsense and you should not fall for this fraud.

The homeowner insurance should be enough to pay for your surgery, your loss of normal life, your pain and suffering and possibly for any future medical expenses.

You should talk to an attorney at once and without any further delay and don't let these insurance adjuster short change you.

If you need any additional help call my assistant Angela and make an appointment for us to meet or talk over the phone.

I hope this helps,

Dear Sirs:

You may have a premise liability case against the owner of the property.

We would ask that someone take photos of the area where you fell.

Should you wish us to review these photos to determine if you have a valid premise liability case, please do not hesitate to call.

Many thanks.

You should pursue a claim with your parent's insurance company. They likely have no basis to deny your claim. Feel free to contact my office to discuss in further detail.
