Legal Question in Personal Injury in Illinois

Infected with scabies

I was staying at a hotel for two nights the first night i stayed there nothing was wrong later on the next night i started itching really badly and got a bad rash. I called the front desk and they had their onsite medical person to come look at me and they too pictures of the rash and told me to go to the doctor. I went to the doctor and was diagnosed with SCABIES. My question is do i have a case against the hotel and if so how do i go about everything. Thank you

Re: Infected with scabies

It depends on whether you can show that the hotel had notice of the existence of the mites or through the exercise of reasonable care they would have been able to discover it. It will be difficult if this is the first and only event, but if will be rather easy if there is a history of this sort of infections.

There is not much you can do by yourself. You will be stonewalled by the hotel's insurance company and their employees. Your only chance, in my opinion, is to get yourself an experienced lawyer and let him or her get the info and prosecute the matter for you.

I hope this helps-contact my office with any additional question(s).

Re: Infected with scabies

You have a case if you can prove that the scabis came from the hotel and that the hotel had prior notice of the problem and did not take proper precautions. Scabies is usually transmitted from skin to skin contact, although transfer from a recently used

towel or sheet is not entirely uncommon.

Assuming that you can prove fault, the next question is how much have you been damaged. How long did you recveive care? How much did it cost?

Is there any permanent scarring?

If there was minimal care, you might want to submit the bill to the hotel. If a chain, submit it to corporate, there is a chance that they will pay the bill or at least comp you with a room. Otherwise you could file a claim in small claims in the state where the hotel was located.

If there are significant damages, you should hire an attorney as the hotel will deny a major claim.

Good luck.
