Legal Question in Personal Injury in Illinois

lien & liability

Hi, I wanted to find out if it is legal for a doctor to 'balance bill' my liability claim even though he was paid through my medical insurance for the bill.

Re: lien & liability

It depends on the type of contract he has with the insurance company. Usually you are can be held responsible for the 20% remaining if the insurance has paid 80%.

If your medical bills have been paid by medicare or public aid, the doctor is acting illegally.

If you are in doubt, contact Illinois Department of Professional Regulation and see if the doctor's action warrants reporting him to the board.

I hope this helps,
