Question about insturance settlement

My 5 year old daughter was struck by a car this summer. I've been offered, from the insurance company of the driver, a settlement of the medical and ambulance bills (which is fair) an initial $250 (now $500) addon for ''pain and suffering''. My wife and I are asking for about $3700 to cover ''pain and suffering'' and work time off. Total out of pocket with bills to the insurance company would be less than $5000. I was offered the $500 p&s settlement after making our desires known and threatening to bring a lawyer into play. Are we being unreasonable in asking for this type of settlement? We live in the Chicagoland area and feel like we aren't being taken seriously as a result of not having a lawyer involved. My daughter does not seem to have any lasting effects from the accident but she had nightmares, lost a day or two of school, and we had to take time off the day of the accident and the day of the court hearing. You need to provide more detail in order to receive a valid response. What were her injuries? What is the name of the insurance company? What were the facts of the occurrence? Please post more information.

There is a lot to consider when comes time to talk about the amount of settlement. The injuries are just one aspect of it. How the accident happened? How long after the accident was doctor(s) seen? What sort of doctors were seen/ What were their diagnosis? Prognosis? Is there a claim for lack of supervision--where was the 5 year old and why was she there by herself? Etc.. etc... So in order know whether $500 is fair or not, you must provide a LOT more information.
