Son hurt at neighbors

Our new neighbors asked my son if he would like to make $5.00. They wanted him to help with a deck they were building he came inside to get his electric screwdriver to help screw in some screws. Approximately 20 min. later we heard our grandaughter screaming. One of the men had cut Dakota's fingers with a saw. The saw had severed the pinky of the right hand and shaved the bone and cut the tendon and artery of the right ring finger. A plastic surgeon was able to reattach both fingers. He is going through therapy now and is just not doing very well at all. This happened May 03, 2008 and He still will not be ready I do believe when school starts. He is very active and involved in several sports and loves hunting & swimming. So far this summer he had been able to do nothing. He is right handed and this has really handicapped him. Now I am having trouble with my insurance getting the therapy sessions that the plastic surgeon say's he needs. Where do I go from here? The neighbors came over after we got him home from surgery and offered their insurance. My husband was livid at the time and told them we had our own insurance. Can I ask for theirs now? His whole life has changed and I am just on excessively worried momma. Any advice.

You can ask for and get their insurance

information. Their homeowners insurance

policy should have coverage both

for medical expenses and for their

liability in causing your sons's

injuries.

You have to be careful about making

any statements to their insurer.

A minor has until 2 years after he

reaches 18 to make a claim, so you do

have some time.

If my son had such an injury, I would

pursue a claim for his medical expenses, pain, disability and

scarring.

If they have homeowner's insurance, this accident would likely be covered under their policy.

How horrible for your son and family! I was seriously injured as a teen and spent months recovering. I can still recall the frustration and fear and still have somne residuals from the injury thirty years later.

You need to contact an attorney as soon as possible. THE MOST IMPORTANT THING IS THAT YOUR SON RECEIVE THE NECESSARY CARE AND REHAB AS SOON AS POSSIBLE. Any delay can result in a more difficult recovery. You may have options concerning your own insurer, possibly the neighbors as well as the person who actually caused the injury,if he was not the neighbor.
