Sueing after damageing my vehicle

I witnessed a known man driving down my alley twice before i headed down to my car in the alley he lives no where near me, this is after i had him arrested for running me off the road, I heard a loud pop as i exited the apt door i swa him walking fast and into his van and sped away, my car was there with four slashed tires and a poped rear window 1,299.00 damage insurance did not cover, i filed complaint but he ghas not been arrested yet they say its a hard one even though i saw him there and here the noise i did not see him do it, can i file a civil case sueing him for recovery of damage all i have is him being there and hearing the popping of the window it seems obvious to me he did it... is this easier to prove in civil court then criminal ?

The burden of proof is beyond a reasonable doubt for criminal cases, more likely than not for civil. O.J. got off on the criminal case, he lost the civil case in the amount of $30,000,000.
