contracts-covenants and restrictions

I guess I did not make my question clear enough before, sorry. My question is �do I have to abide by the indenture of trust and restrictions that was filed by the developer 4 days after we had already signed real estate sale contract?�

We signed sales contract on 3/25/03 and developer filed indenture 4 days after on 3/29/03. I closed on the house in Aug. 03. I was not made aware of this change until 7/3/08. I know it is my obligation to make sure of any covenants on development and I did so before signing contract. So again I ask �am I at fault or should developer have informed me of this before closing?� What are my legal rights?

One would have to review the contract. Also, chances are that the recorded restricitons would show on your title committment. You should read over that also.

You have 10 years to sue the developer. You need to contact a local attorney.
