thank you for the quick response to my question.i do and have understand about consulting legal advice it such matters.unfortunaly i did not see the need to seek legal advice since we had planned to be married.

can you please shed a little more lite on what is involved in filing for a partition of the property and what a forbearance agreement is?

i beleive that i may have to go this way since she will not discuss this with me anymore.(not that she really did)

I do understand that the house needs to be put up for sale and it had been

this is part of why i did not pursue further actions.but she had taken it off the market and i have know idea if she intends to place it on the market again.i know that she can not assume or refinance the mortage on her own.

A partition suit is probably too complex for pro se, so you will have to hire an attorney. In general terms, you presently own a share of one property. You are asking the court to divide the property into two parts, with separate ownership of each part. Since this is a residence, doing so is not really possible, so instead, the court orders that the property be sold and that the two of you split the proceeds. If this was farmland, the property could be divided and there would not be a need to sell in order to apportion interest.
