Legal Question in Real Estate Law in Illinois

Hello, I live in a 30 unit condominium building with a shared garage. Someone hit my car in the garage. Unfortunately, nobody left a note and I can't tell who may have done this. Assuming there is nothing in the bylaws, can I sue my condominum association for the repairs which have been estimated at $500 (I would ask them to pay first, but I doubt they will agree)?

Thank you,

R. Peters

What would be your theory of liability against the condo association? There is no reason for them to be liable. So, no. You cannot sue the association. You can either find the person who hit you and/or file a claim with your insurance company.

You can sue anyone for anything, but I cannot fathom how your condominium association is responsible. You could possibly be sanctioned for bringing a lawsuit which has no merit or basis in law.

Why do you think that the Association is responsible?
