Mobile Home Contract for Deed Breech

My fiancee recently entered into an agreement to sell her mobile home for a small down payment and monthly

installments. We sold it to a fella who could not take possession right away, so we agreed to stay and pay the lot rent for 3 months, when he would assume all payments. The contract also included an agreement

with the buyer stating he would make a few needed repairs. He did not pay on time and didn't make some repairs, and we fell behind on some bills. Now we can't afford to move. My old lady wants to say he breached the contract and cancel it. The contract also stated that neither party would take the other to court. Please tell us what the appropriate thing to do would be. Thanks

If he did not pay and you made no concession to let him pay late, then he is in breach and the contract is voidable and you can start over. Depends on the language of the contract, a lawyer would need to see to be sure of your position.
