Owner dies while selling property

Hi,

I have a situation where I am purchasing a property in Chicago, IL and we are not sure if the owner had a will and he just passed away. What are my rights having signed a contract with the legal guarding. Do I have a right to purchase this property. My lawyer has no experience with this and neither does the real estate agent. I have put down 5k and we were suppose to close in two weeks now I don't know and I have told my landlord I am not renewing my lease. Any advise to this complicated issue?

By "legal guarding" I assume you mean "Legal Guardian". I would suggest that you get a certified copy of the appointment order and let me or another attorney qualified to do real estate work look it over. Otherwise, you could be living in your car.

It is unclear if you had a contract with the owner before he passed away, or if the contract was with a guardian before his passing, or if the contract was signed with the guardian (perhaps the executor of the estate).
