Real Estate Partnership

18 years ago my brother and I bought a home, we are on the loan equally and the property is in trust. I am reaching retirement age and I want to sell the home and leave the state, my brother does not want to sell the home. The home is my investment for retirement. Can I force the sale of the home? Will I need to take him to court todo so?

This partnership can be broken up in court. In theory, you could sell your half interest to another party without going to court, but it's unlikely that you would find a buyer willing to purchase your interest on that basis. Yes, you can force the sale and yes, you will have to go to court to do so.
