removal of addition after it was approved

we went through the proper steps and received permission to install an above ground pool in our backyard from our homeowners association we have had it there for about 2 yrs now.our mgmt company changed hands and now sent us a letter stating that the pool will have to be removed within 5 yrs. can they legally make us do that? what about the costs involved to do so and what steps ultimitly can they take to make us remove it? we were just about to add a deck around it but we will need approval and in light of this letter I don't think they will approve. Do we now just have to go along w/ all of their requests? we own our home.

Well, you own your home subject to the conditions of record, and one of them is the condo dec. It seems to appear that your pool would be "grandfathered" in, and I do hope that you have the paper work for that. The management company has nothing to do with the HOA. Spend a couple of dollars and let a lawyer look at your paperwork! Money well spent.
