Repairs for builder defects

Our HOA is attempting to force homeowners to pay for repairs to exterior walls (due to moisture build-up) caused by poor workmanship by the builder. They are also attempting to force us to purchase new windows. Aren't outside walls common elements as outlined by Condominium Act? Builder went out of business.

I'm pretty sure your outside walls are common elements (or limited common elements). But if repairs are needed, a special assessment may be the only way to pay for them.
