If you are currently making back child support payments will they still take your tax return? If so why? What can you do to stop this?

Check with the State's Child Support office to see if there is anything you can do to stop them from taking your refund.

However, if you have an agreement in force with the State, it doesn't necessarily mean that they won't take the tax refund as well, up to the amount you owe.

If you are remarried, your spouse can claim his/her refund by either filing a separate return, or by filing for innocent spouse protection.
