Accident with no insurance

I was in a hit and run accident on 6/23/2008 and I managed to get the car's license plates and possibly see the driver. I reported the accident that night. The officer said that the owner of the car is saying he does not have insurance and someone else was driving his car. The officer wants me to see if I can identify the driver. I want to know if I cant what are my options. Even if someone else was driving his car is it still his responsibilty for my damages. I tried to go through my insurance company but they gave me an estimate way lower than the body shop did and I don't know what to do. Please help. Thanks.

Typically, even if the driver of the car was not the owner, if they WERE insured, their insurance would be paying and then if the actual driver were insured the insurance would go after that driver's insurance. I would recommend consulting with a local attorney who deals with car accidents who can help you figure out the best thing to do in your situation.
