Legal Question in Traffic Law in Illinois

Is crossing guard a pedstrian?

I rec'd citation for making right hand turn on red when posted sign said "No right hand turn on red while pedestrians present"

The only person present was a crossing guard standing on the grass near the intersection. She was not crossing. There were no children or others present.

Is the crossing guard a pedestrian under these circumstances?

Hello. That is a ticket trap!

It is best not to make a right

on red at this type of

intersection because the

officer is able to argue that

at a particular time of day,

children are likely to be

present.....even though you

may not see them all the time

at that location and time....

....wait for the green to go.

You have an interesting question; and the facts, in my mind, present a defense. You should retain an attorney to represent you.
