Legal Question in Traffic Law in Illinois

i was driving my sisters car and another car took the red light while talking on the phone and crashed into me...im not in my sisters car insurance...my sister filed a claim with his insurance and they have been trying to contact him..we contacted him and he said he wont call his insurance back to approve the claim because i wasnt in my sisters car insurance...i need help to get him to approve the claim to for the damages caused to my sisters car

You don't have to be "on" her insurance as long as she says you were an authorized driver and she was not otherwise required to name you as an additional driver on her car. If the other insurance company is rejecting the claim on these grounds, then she can file a claim with her insurance and let the two insurance companies duke it out, but she could be out her deductible until there is an admission of liability. Therefore, it may be worthwhile to hire an attorney who can get the ball rolling.
