Legal Question in Traffic Law in Illinois

My husband was in an accident 4 years ago where he was hit into a car by another car that fled the scene. he was driving his friends car who had no insurance and they are being sued by the insurance company of the person they hit. Is that legal or right seeing how they themselves were hit? it is even stated in the police report that they were victims of hit and run. My husband's license was suspended due to the lawsuit and he recently lost his job as a communcation tech due to not having a valid license. The insurance company wants to garnage his wages to pay the amount for the damages but the court wont reinstate his license so he can drive for his job.Shouldnt that be allowed? Also he is only being sued because the person whose car it was only has income from the military and it cant be garnaged. We feel the situation our family has been put in is very unnecessary. My husband cant provide for us. Is there any lawyer or anyone you know that can help us? Any advice would be greatly appreciated.
