When someone can no longer write but has mental capicaty how do you assign power of attorney to someone else?

According to Illinois probate law, in general, a person (who has mental capacity) may direct another person to sign on his/her behalf as long as there are witnesses to attest to the direction of the disabled person, and to the signature.

However, there may be other legal circumstances involved here. You should seek the advice of an attorney who concentrates in estate planning to have him/her review your situation. Only a person who has all the facts at hand will be able to give you a definitive answer.
