Legal Question in Wills and Trusts in Illinois

The executor for husband's will has not filed federal income taxes on late husband. How can I get him legally to file federal taxes on my late husband? The filing of these taxes affects social security benefits of widow but he has not even filed for 2009, 2010

If you can afford to spend a few dollars on an attorney, I recommend that you hire an attorney to specifically address this issue. If there is a Probate Estate that has been opened before a Court, that attorney will likely contact the Executor's attorney and demand that the returns be filed or else the issue will be brought before the Judge.

If you are very low on funds, and if there is a Probate Estate that has been opened before a Court, then you can appear on the next Court date and ask the Judge to command the Executor to file tax returns as appropriate.

If a Probate Estate has not been opened before a Court, there is a more complex answer. If you'd like to hear it, feel free to call me. I won't charge for the phone call.
