Legal Question in Wills and Trusts in Illinois

Filing a will

A final will was made out in 1989 and was never filed.

Only have a copy of the will (original was disposed of).

Am I able to file this will using the copy?

Re: Filing a will

If you don't have the original of the will, the only way that it can be filed and certified is by court order.

If the will was drafted by an attorney, you should contact that person. He/she may be of assistance.

The judge will most likely want to hear tesimony from the witnesses who signed the original will. Are they still available?

Unfortunately, the copy by itself is not a valid will.

Good luck to you.
