Legal Question in Wills and Trusts in Illinois

Grandfather signed everything over to someone else

My Grandparents had me as the sole heir of their estate. After my Grandmother died recently, grandfather put me on his CD accts. as joint owner. He isnt in his right mind and all of a sudden his brother comes into the picture and grandfather has signed everything over to the brother. The brother put him in a nursing home and just left him there. Do i have any rights to his estate?

Re: Grandfather signed everything over to someone else

Your question has a number of different answers, depending on whether the brother is acting as a fiduciary for your grandfather, and whether your grandfather had the capacity to make such decisions.

Generally, someone who owns a CD or bank account in joint tenancy with another person would be entitled to receive the funds in their entirety upon the death of the first joint tenant. However, if the transaction involved fraud or undue influence, it may not be valid.

You would be advised to speak with an attorney who can review the facts and discuss the issues involved, and also to see whether a guardian should be appointed.

Good luck to you.
