Legal Question in Wills and Trusts in Illinois

Including step-children in wills

Our step-children are currently included in our joint will. How do I ensure my step children will inherit if I die before my husband? That is, how do ensure my husband will keep them named in his will once he has total control of our estate.

The fact that you're making this statement means that you don't believe your husband will do the right thing. You can change your will to distribute to a trust for your minor children. That means that if you own anything "jointly" with your husband you have to change that, too. You need to speak to an experienced Probate ane estates lawyer.
