Legal Question in Wills and Trusts in Illinois

we are living in the home of our deceased mother. The will states the home is to be sold and monies split among all the children. Can the family/executor have us evicted before the home is sold?

It is technically possible, but unlikely. Furthermore, if you offer to pay rent to the estate until you move out/the home is sold, that should make all the other beneficiaries lighten up a little. You may want to point out that a vacant house makes it vulnerable to thieves and vandals and having someone living in the house benefits the estate (caretaker expenses avoided perhaps calling for a reduced rent amount).
