Please realize that my answer is based on the general facts provided by you. Under Illinois probate law, members of the immediate family of the deceased are considered interested persons entitled to a notice of probate proceedings. However, the executor or trustee may not have yet filed a petition or be required to file any petition with the local county probate court. One purpose of a trust is to avoid probate court. If you wish to contest or object to the actions of the trustee or executor, you may file a petition in the probate court, asking the Court to order the trustee/executor to provide such information.

You may be able to find an agency or local attorney who will represent or advise you on a pro bono basis, with little or no charges. If you have a copy of the will or trust, an attorney can advise you regarding your rights under such will or trust.
