Legal Question in Wills and Trusts in Illinois

Previous wills

My husband was previously married and his first wife died They had a will in which he states that after his death his daughter is the executive of his will. We are now married is his original will still valid even though we brought a home together and it's in both our names as well as saving accounts and bonds.

Re: Previous wills

Unless your husband does something affirmative to void the will, it is still valid. One thing he can do is tear up the old will. Another is to make a new will and invalidate all prior wills. Both you and your husband should seek the advice of a lawyer.
