You can proceed in a number of different ways. You can explore certain Trusts and agreements. You can inquire as to if your husband can be adjudicated to be a disabled person (and thus not allowed to manage his own money). In any event, you should contact an attorney so that s/he can help you to craft a solution that fits your individual needs. Feel free to call me. I won't charge for an introductory phone call.

The most urgent thing you need to do is protect your pension plan. If your plan is of a certain type then your surviving spouse will be entitled to it no matter what you say in your beneficiary designation.

Your husband has other rights in your property, so unless you plan properly, he can inherit more from you than you intended.

If you would like to know how to correct this, let me know: www.legacylaws.com. For a free consultation call the number on my website.
