Legal Question in Workers Comp in Illinois

Can work comp tell me this?

I hurt severely pulled a muscle in the middle of my back 4 months ago at work, up to today I have been collecting W.C. well about 3-4 weeks after initail injury my low back started to hurt very bad and is still hurting w/o any relief (the pulled muscle is fine now). The mri I had said that I have a degenerative disk and is bullging now, my doctor tells me that it is impossible that this is a work related injury (this never hurt before and now it is hurting very bad) so after finding this he tells me that there is nothing more he can do and has to release me b/c that disk problem didn't exist on the first appt that i saw him. Work comp tells me that I have to go back to work b/c the doctor has released me. I am in a lot of pain now and I made this clear to my orthopoadic doctor about 3 weeks after the accident, I know that there is no way that I could go do heavy laboring right now. I just got a lawyer, but he really seems like he is unsure of the steps to take here, he basically said that unless another doctor can say that my injury has caused my lower back pain, I really don't have much of a case. Any suggestions Please! Thank You

Your lawyer is correct. But it really depends on the doctor that you have been seeing. I'm can't be sure that he is the RIGHT doctor to make the diagnosis. You would have to discuss this with an attorney who is experienced enough to know the reputations of the doctors. For example, if you have been seeing a chiropractor, he should not be making that opinion. You have yourself in a real mess now that you can only get out of with a lot of competent help. In the meantime, you will probably go a long time with no money.
