Legal Question in Workers Comp in Illinois

can I still work?

I was injured and have to have surgery on both of my shoulders and they said that it will take a year to rehab. That's fine, but can I work doing something else to make up the money that I am not making because they only pay me 66%? Will they stop paying me my comp checks?

With injuries this serious I certainly hope that you already have a good worker's compensation attorney. If so, you should direct all of your questions to that attorney. Forget about the nonsense advertisement people do on here--some people don't know that this forum is for answering questions and not just copy and pasting a "call me" type of an answer.

Anyway--If you can work, you would not be entitled to your time off work. So, if you want to work, you should simply go back and do your job. If you cannot do your job, perhaps you can be on light duty. It all depends on what the doctors say and what are the facts of your case.

The best way to proceed for you is to consult an attorney to make sure your interests are protected.

If you work, and earn income, it WILL effect the amount you are entitled to get from workers comp. It depends on how much you were making, and how much you can make now.

ANSWER:

If you tell the insurance company that they have to pay you benefits because you cannot work, then you cannot work anywhere.

Yes, they will stop paying you the 66% if you work elsewhere.

In fact, they may have you arrested for workers compensation fraud.

Your situation seems serious, so I would recommend that you hire a lawyer who can provide you with these answers (and prevent problems from arising in your case!).
