Legal Question in Banking Law in India

Bounced check

Ours is a public charitable trust registered. We provide hostel and mess facility to needy and poor students. We work on public donations and certain services provided in our premises.

We gave our hall in the hostel premises to Techno Corps. Bavdhan, Pune for Rs. 37,753 They paid Rs. 30,753 And their cheque for Rs. 7000/- Ch no. 232514 dated 12.07.08 drawn on Bank of Maharashtra, Pune was bounced. We tried to contact them and persuaded to pay the charges. The amount being small we did not go through the legal action.

Please advise us what is the best alternative under this situation.

6 mobths have been lapsed now you can file recovery suit.

Of course you can file a suit for recovery and go through the process. If the drawer has no identifiable proprietor, nothing can be recovered. Since you are a charitable organization, and the expenses for recovery will be much and there will be unfathomed delay, the best thing is to write to the drawer, that if they fail to pay the amount due, they will be subject to divine wrath for having defrauded a charitable trust and if they don't pay within a fortnight, the cheque with their details will be deposited in the hundial of Tirupathi Balaji. if they don't respond, arrange for sending the cheque with details to Tirumala Tirupathi Devasthanam to deposit the same in Hundial and try to recover the same as an offering from a devotee.

You can send legal notice to the said firm to calim your amount. But there is no other way other than filing civil suit for recovery of money.

Well!! you can either proceed through the legal route which may cost you a bit and there are chang=ces that you may recover the cost by way of compensation or forego the amount. Such decision has to be taken by you.
